                              I, PATRICK MANNING, P.A., the undersigned, declare as follows:
          22            1. This declaration is made in support of my request that my deposition testimony be used at
          23                  trial in lieu of my appearance due to my unavailability to appear in person despite being
          24                  served with Defendants’ subpoena for trial.
          25            2. I am currently employed as a physician assistant at South Bay Kaiser Medical Center, and
          26                  have been for approximately twenty-four years. As a physician assistant, I usually work in

          27                  family medicine and urgent care taking history and conducting physical exams for patients
                              that present with medical complaints.
