The Court has read all documents filed and reviewed the original Motion For A New Trial. The Court rules on Plaintiff’s evidentiary objections filed on 1/31/2022 as follows: All of the objections are overruled except as follows: Objection #9 -- the objection to the first clause to the word "because", is sustained; Objection #10 -- the objection to the last sentence is sustained; and Objection #11 -- this objection is sustained. The Motion is heard and argued. The lawyers corrected the Court that the situational Use Of Force chart, Exhibit #302, included the use of a K-9 force with personal weapons, tasers, impact weapons, carotid restraint, less lethal weapons, and the TARP procedure in the "assaultive/high risk" category. Firearm use was included in the "life threatening/serious bodily injury" category but was not with K-9 force. In this case, there was no evidence any force other than K-9 force was considered. After consideration of the moving and opposing papers and the argument of counsel, The Defendant's Motion for Reconsideration OF ORDER GRANTING PLAINTIFF’S MOTION FOR NEW TRIAL; filed by County of Los Angeles on 01/14/2022 is Denied.
