Dear Justice Cohen:
As counsel for Defendants, we write in response to the letter electronically filed this
afternoon by Anthony Harwood, Esq., counsel for Plaintiffs, in which Mr. Harwood requests that
the Court exclude Defendants and their counsel from the hearing on the motions to withdraw.
(Dkt. No. 1502.)
Defendants object to the sealing of the hearing on the motions to withdraw. Plaintiffs
recently filed a Notice of Appeal from the Court’s Decision and Order on Motion dated February
21, 2023 in connection with Motion Sequence Nos. 42, 44, 45, 46 and 47. In those motions,
Defendants put “at-issue” the cause for the delay in taking discovery and now, apparently, intend
appeal this Court’s order. Accordingly, Defendants intend to move this Court for an order
unsealing and/or un-redacting the documents filed by Plaintiffs and all Plaintiffs’ counsel in
connection with the pending motions to withdraw as they relate to the causes of delays in taking
discovery pre-Note of Issue.
Defendants intend to appear in person at the hearing on April 14 (we note that the original
return date of April 6 was adjourned in light of the Passover holiday).
