Velasquez Deputy Sheriff: None APPEARANCES: For Plaintiff(s): No Appearances For Defendant(s): No Appearances NATURE OF PROCEEDINGS: Court Order re: Entry of Default Judgment After reviewing the Default Judgment packet and proposed Judgment lodged on 9/3/2020, the Court does not enter default judgment and instead rules as follows: Plaintiffs Anait Safrazbekian Family Trust and Sherman Oaks Congregate Center, Inc. (collectively, Plaintiffs) filed suit against Lusine Avetisyan and AHS Healthcare Partners, Inc., alleging: (1) breach of common stock agreement and written escrow instructions dated 10-31-18; (2) fraud; and (3) express indemnity. This action arises out of Plaintiffs’ purchase of the Sherman Oaks Congregate Center (Center) from Defendants. Plaintiffs allege that Defendants failed to pay numerous outstanding debts and monies owed in violation of the common stock agreement, and seek indemnification pursuant to the agreement. Plaintiffs also allege that Defendants fraudulently misrepresented that they had filed state and federal tax returns. Plaintiffs now seek the entry of default judgment. CRC 3.1800(a)(7) provides that any party seeking a default judgment on declarations must include: … (7) A dismissal of all parties against whom judgment is not sought or an application for separate judgment against specified parties under Code of Civil Procedure section 579, supported by a showing of grounds for each judgment Minute Order Page 1 of 2
