I am concerned about your second motion in limine. It references that a motion to augment the
expert disclosure was filed on Feb. 1, 2023 with the court. We were never served with that
motion and have never seen it until today. It also adds concern given I engaged with Mr.
Tapley on significant requests for him to seek leave which he patently refused. Unilaterally
filing a motion without service is another example of unfair gamesmanship. Please withdraw
the underlying motion and motion in limine that relies upon it. Failure to do so will require us
to inform the Court of a lack of due process and improper ex parte communication.
