Court Call, LLC, et al. 1. Cory Brookshire’s Motion to Vacate the Order to Dismiss RULING Cory Brookshire’s Motion to Vacate the Order to Dismiss is denied. Background Plaintiff filed his Complaint on January 27, 2021. Plaintiff alleges the following facts. The action arises from Defendant’s alleged conduct in a prior action in which Plaintiff was a party - Case Number 18STCV03281. Plaintiff contends that Defendant improperly muted Plaintiff during a court hearing. Thus, Plaintiff believes that Defendant breached its contract with Plaintiff with respect to providing remote calling court services. Plaintiff also sets forth intentional and negligent torts against Defendant. On March 25, 2022, Defendant’s motion to dismiss this action was granted. Request for Judicial Notice As a threshold matter, the Court, on its own motion, takes judicial notice of the contents of the records of the Court in the instant action pursuant to Evidence Code section 452(d).
