Exhibit 9 (March 23, 2023, email from Van Steenis to Vierra conferring on Plaintiffs’ Request for Entry of Default)3/23/23, 4:58 PM Gmail - Entry of Default hh Gmail Ryan Entry of Default 1 message Ryan Thu, Mar 23, 2023 at 2:36 PM To: "Vierra, Collin" Greetings Collin, In trying to file Defendants Bragg and SVRV's motion to strike, the filing clerk rejected the filing because the “defendants are currently defaulted. Therefore, clerk cannot accept until default is set aside." | am not sure if this is a clerk error (since Bragg's Memorandum of Points and Authorities in support of the motion was accepted by the clerk), or | mistakenly read the court's entry on 3.9.24 which (I thought) granted an extension of time to answer. In any case, | wanted to confer with you about the default and whether you would consider withdrawing it. | assume | know the answer, but wanted to ask in the event we could lessen the law and motion work on the parties and the court. If the answer is no, then | will get a motion on file to set it aside. Let me know your thoughts.
