COORDINATION AND APPLICATION FOR

INTRODUCTION
TikTok Inc. and ByteDance Inc. (collectively, “TikTok”) do not oppose the formation of a
coordinated proceeding for cases involving claims of adolescent social media addiction and related
personal injury, as requested by JCCP Petitions filed by the Social Media Victims Law Center
(JCCP 5255) and Motley Rice (JCCP 5256). In establishing a coordinated proceeding, however,
TikTok submits that there should be a single JCCP encompassing all such cases. To have two
separate but overlapping JCCPs, as advocated for by Motley Rice, would negate the utility of
coordinating cases, undermining the very reasons for coordination in the first instance: judicial
efficiency, consistency, and convenience of the parties.
10 Further, TikTok agrees with Meta Platforms, Inc.’s (“Meta”) Response in Support of
11 Coordination, that the actions should be coordinated in San Mateo County given the locations of
12 the parties and witnesses, as well as its accessibility and convenience for parties and counsel.
13 Indeed, a plurality of cases are already pending in San Mateo County.
14 ARGUMENT
15 I If the Court Elects to Coordinate, There Should Be One JCCP, Including All Cases in
SMVLC’s and Motley Rice’s Respective Petitions.

17 The plaintiffs represented by Motley Rice assert that their cases, filed only against Meta-
18 related entities, should proceed in a JCCP separate and apart from another JCCP petitioned for by
19 Social Media Victims Law Center (““SMVLC”), which encompasses cases involving Meta and
20 other defendants. TikTok supports the positions presented by Meta and SMVLC that if the Court
21 finds that coordination is appropriate, the cases should instead be coordinated in a single JCCP.
22 While important factual distinctions do exist between the defendants and their respective
23 platforms, the impracticality and inefficiencies of two parallel JCCPs—premised on similar
24 allegations, causes of action, cross-cutting legal defenses, and alleged injuries, against similar
25 groupings of defendants—are enough to overcome any factual differences or variation in named
26 defendants. As Meta pointed out in its response, the Judicial Panel on Multidistrict Litigation

recently decided to consolidate federal cases into a single MDL that alleged similar causes of
action and personal injuries against various groupings of the same defendants, including Meta-
only cases and multi-defendant cases. Jn re Soc. Media Adolescent Addiction/Pers. Inj. Prod.
Liab. Litig., No. MDL 3047, 2022 WL 5409144, at *2.
Il. The Coordination Factors Favor San Mateo County.
If the Court determines that coordination is warranted, San Mateo is the most appropriate
venue for this JCCP. Between plaintiffs’ two coordination petitions, a plurality of the cases, i.e.,
6 of 20, are pending in San Mateo County, and three more are venued in other Northern California
counties. San Mateo is also home to Meta’s principal place of business, and several other
10 defendants like ByteDance and Google are headquartered nearby. See Meta’s Response, 12. San
11 Mateo County will be particularly convenient for the parties, witnesses, and counsel, and it is
12 accessible both to those residing out-of-state and in Southern California. See id. Further, San
13 Mateo County judges have the capacity to take on a large, coordinated proceeding like the cases
14 at issue here. Complex civil judges Robert D. Foiles and V. Raymond Swope are not currently
15 overseeing any JCCPs. And there are currently only five total JCCPs pending in San Mateo
16 County at this time, compared to the 19 currently pending in San Francisco County.
