NATURE OF PROCEEDINGS: Court Order

The court notes that a Motion for Appointment of JCCP Interim Steering Committee and Liaison
Counsel has been filed in JCCP 5255 and purportedly set for hearing on February 17, 2023. The
court takes that motion off calendar.

The Minute Order of January 17, 2023 stays JCCP 5255 and all included actions. That minute
order also states that “[c]ounsel on both sides should agree on a proposed order to address such
matters as which counsel will take the lead on notice, service and drafting pleadings to be joined
in by other counsel on the same side in the litigation.”

The court prefers to deal with appointment of a Steering Committee or Interim Steering
Committee in the context of the Initial Status Conference.

If there is a disagreement among counsel on one side in this litigation regarding the structure of
the organization of counsel, that disagreement should be discussed in the Joint Initial Status
Conference Report. If there is no disagreement, the court will likely defer to the parties’
proposed organizational plan.
