·4· ·657193 of 2020. On December 19, 2022, we received
· · ·a letter from Steven Younger of the Foley Hoag
·5· ·law firm in which he indicated that they would be
· · ·available for a deposition on today, December 22,
·6· ·2022, and requested that we provide availability
· · ·for our witnesses. We responded by advising that
·7· ·Denise Bauman was available to take her
· · ·deposition today starting at noon. The witness is
·8· ·here ready to be deposed. Mr. Younger indicated
· · ·by an e-mail earlier today that he would not be
·9· ·in attendance today and we have advised him we
· · ·intend to treat the deposition as having been
10· ·waived based upon his failure to appear.
· · · · · Again the witness is here along with my
11· ·partner Rachel Shaw and we are ready, willing,
· · ·and able to proceed with the deposition but for
12· ·the fact that the plaintiffs and their
· · ·representatives have failed to attend. We are
