On August 23, 2011 in Department 206 of this Court, plaintiff/cross-defendant
Elizabeth Fetter’s motion for an order continuing the trial to a time to be determined by
the Court and an order reopening discovery for all purposes came on regularly for hearing.
Andrew M. Zacks and Anthony C. Soldato appeared on behalf of the moving party and
plaintiff/cross-defendant Elizabeth Fetter. Rod Divelbiss appeared on behalf of plaintiffs
Alexa and Ethan Rudin. Ed Haas appeared on behalf of defendants/cross-complainants
Hill & Co., Barbara Friedman, and the Estate of Malcolm Post.
The Court having reviewed the parties’ papers, and finding GOOD CAUSE hereby
ORDERS: plaintiff/cross-defendant Elizabeth Fetter’s motion for an order continuing the
trial and reopening discovery for all purposes is GRANTED.
IT IS FURTHER ORDERED that the trial date of October 3, 2011 is continued
to December 5, 2011 in Department 206 at 9:30 a.m. The current settlement conference of
September 16, 2011 at 9:00 am in Department 608 shall remain as scheduled. The
discovery cut-offs shall track the new trial date. The requests for judicial notice are
GRANTED.
