271 Successor Trustee of the Rosia L. Hart Revocable Trust (“Former Trustee’).

2. On May 9, 2012, this Court authorized the Law Offices of Daniel A. Conrad
(‘litigation counsel”) to represent Former Trustee to “secure the rental income streams
from the Newhall and Suisun City properties, including bringing unlawful detainer actions
if necessary, dissolve Bayview Village LLC, and pursue collection efforts against
Gregory Wiggins, including a debtor's exam”.
3. Pursuant to this Court’s May 9, 2012 order, Former Trustee paid litigation
counsel a retainer of $3,500. On July 10, 2013, this Court awarded fees for legal
services provided to Former Trustee from December 6, 2011 to February 28, 2013 in the
amount of $15,961.69 as a judgment debt in favor of Daniel A. Conrad with interest of
5% per annum to be secured by a lien against 950 Newhall Street, San Francisco
(‘Newhall Street’). The balance of this award now due to litigation counsel is $14,329.63
plus accrued interest.
4, Litigation counsel’s services to Former Trustee are as follows:
a) General services. Litigation counsel's general services to Former Trustee
include reviewing the listing agreement for the laundromat at Newhall Street, reviewing
bill files regarding costs advanced, and reviewing the Request for Judicial Notice filed on
September 4, 2013 by co-counsel Andrew Schultz.
b) Gregory Wiggins.
Newhall Street is a property once owned by Bayview Village LLC, a limited liability
company formed by Gregory Wiggins and Rosia Hart. Litigation counsel successfully
caused the dissolution of the LLC. After Bayview Village LLC was dissolved, litigation
counsel and co-counsel Andrew Schultz discovered that, prior to Former Trustee’s
involvement, the architects Baum Thornley recorded a design professional's lien against

Newhall Street and were subsequently obtained a default judgment against Bayview
Village LLC. Litigation counsel researched the validity of Baum Thornley Architects’ lien.
Litigation counsel obtained title documents provided by Old Republic Title Company.
Litigation counsel communicated with Former Trustee regarding Baum Thornley
Architects, Litigation counsel's research was extensive due to the complexity of issues
regarding the effect of the court’s order rescinding the deed to Bayview Village LLC and
restoring title to Rosia Hart, and the chain of title wnen Baum Thornley Architects
recorded their lien.
Gregory Wiggins testified at his debtor's exam that he had a bank account at the
San Francisco Police Credit Union which contained approximately $100. Litigation
counsel prepared a Writ of Execution and other forms to levy the monies in that bank
account. Gregory Wiggins had closed his account at San Francisco Police Credit Union
before the levy was served.
At his debtor’s exam on January 22, 2013, Gregory Wiggins stated that he
received $2,000 per month in rent from 211 Tanager Way, Hercules (“Tanager Way’).
Gregory Wiggins currently holds title to the Tanager Way property. Litigation counsel
researched the process of levying the rents paid by Vanessa Bowman, current tenant at
Tanager Way. Litigation counsel worked with co-counsel Andrew Schultz to prepare the
Writ of Execution and Notice of Levy in order to levy the rents from Tanager Way.
Litigation counsel submitted the documents to the Contra Costa County Sheriff's Office
on August 5, 2013 and received the first levied rental payment in October 2013. Contra
Costa County Sheriff's Office prepares the rent checks payable to litigation counsel.
Upon receiving the checks, litigation counsel endorsed the checks in favor of Former

Trustee. Contra Costa County Sheriff's Office has sent checks for this rent levy totaling
nearly $12,000.
U.S. District Court Judge Charles Breyer contacted me - “not as a judge” -
because he knows the tenant's family. He asked me to advise Former Trustee not to
pursue the rent levy. | did not agree, and the rent levy has been effective.
Former Trustee filed his resignation as trustee on January 29, 2014. Paula Bibbs
was appointed as temporary successor trustee on January 30, 2014 and was appointed
as general successor trustee on March 25, 2014. Upon receiving the rent checks from
the Contra Costa County Sheriff's Office, litigation counsel sent two letters to Ernest Der,
attorney for Paula Bibbs, to request that he ask the Contra Costa County Sheriff's Office
to make the checks payable to him instead of litigation counsel. Litigation counsel has
instructed the Contra Costa County Sheriff's Office to send the checks directly to Ernest
Der.
c) Fee petition. Litigation counsel prepared and filed Petition for Order to Pay
Litigation Counsel Fees, to Continue Legal Representation, and to Waive Notice to Trust
Beneficiary (the “fee petition’) on March 29, 2013. The fee petition requested 1)
payment to litigation counsel for legal services provided to Former Trustee from
December 6, 2011 to February 28, 2013 in the amount of $17,368.69 and 2) to waive
notice of hearing to trust beneficiary Gregory Wiggins.
Subsequent to filing the fee petition, on June 14, 2013, this Court issued Probate
Examiner's Notes which requested that litigation counsel file an Ex Parte petition in order
to request authority to waive notice of hearing to Gregory Wiggins.

Beneficiary of Petition for Authority to Pay Litigation Counsel Fees and prepared a
Supplement to Petition for Order to Pay Litigation Counsel Fees. Litigation counsel filed
the Ex Parte petition and supplement on June 25, 2013 and prepared an order approving
6|| the Ex Parte petition. On June 27, 2013, this Court granted litigation counsel’s Ex Parte
7] petition to waive notice to Gregory Wiggins.
8 Litigation counsel served the fee petition, filed the Notice of Hearing, and

prepared the proposed order. On June 27, 2013, this Court issued Probate Examiners

Notes. Litigation counsel reviewed the Examiner’s Notes and prepared for the hearing.
42|| Litigation counsel attended the hearing regarding the fee petition on July 1, 2013. On
13]} July 9, 2013, this Court awarded fees to litigation counsel for services provided to
141 Former Trustee from December 6, 2011 to February 28, 2013 in the amount of
$15,961.69. On July 31, 2013, litigation counsel recorded the July 9, 2013 Order as a

18 Litigation counsel's services to Former Trustee also include coordinating with co-
191| counsel Andrew Schultz to add this current fee request to Former Trustee’s Fourth and
20] Final Account filed on April 21, 2014.
5. Litigation counsel incurred fees in the total amount of $14,534 for services
provided to Former Trustee from March 1, 2013 to April 2, 2014 and costs in the amount
of $972.74. Attached as Exhibit A is a detailed listing of the legal services provided and
251] costs paid by litigation counsel. On September 4, 2013, Former Trustee paid $1,177.11
2611 for costs incurred by litigation counsel from February 28, 2013 to August 5, 2013 (see
Exhibit B). The balance on this award now due to litigation counsel is $14,329.63, plus
accrued interest.

School of Law, and worked under attorneys who have been active members of the State
Bar of California for at least one year. The paralegal services of Melanie S. O’Brien

Conrad (‘litigation counsel”) to represent Former Trustee to “secure the rental income streams from the Newhall and Suisun City properties, including bringing unlawful detainer actions if necessary, dissolve Bayview Village LLC, and pursue collection efforts against Gregory Wiggins, including a debtor's exam”. 3. Pursuant to this Court’s May 9, 2012 order, Former Trustee paid litigation counsel a retainer of $3,500. On July 10, 2013, this Court awarded fees for legal services provided to Former Trustee from December 6, 2011 to February 28, 2013 in the amount of $15,961.69 as a judgment debt in favor of Daniel A. Conrad with interest of 5% per annum to be secured by a lien against 950 Newhall Street, San Francisco (‘Newhall Street’). The balance of this award now due to litigation counsel is $14,329.63 plus accrued interest. 4, Litigation counsel’s services to Former Trustee are as follows: a) General services. Litigation counsel's general services to Former Trustee include reviewing the listing agreement for the laundromat at Newhall Street, reviewing bill files regarding costs advanced, and reviewing the Request for Judicial Notice filed on September 4, 2013 by co-counsel Andrew Schultz. b) Gregory Wiggins. Newhall Street is a property once owned by Bayview Village LLC, a limited liability company formed by Gregory Wiggins and Rosia Hart. Litigation counsel successfully caused the dissolution of the LLC. After Bayview Village LLC was dissolved, litigation counsel and co-counsel Andrew Schultz discovered that, prior to Former Trustee’s involvement, the architects Baum Thornley recorded a design professional's lien against DECLARATION OF DANIEL A. CONRAD IN SUPPORT 228 Newhall Street and were subsequently obtained a default judgment against Bayview Village LLC. Litigation counsel researched the validity of Baum Thornley Architects’ lien. Litigation counsel obtained title documents provided by Old Republic Title Company. Litigation counsel communicated with Former Trustee regarding Baum Thornley Architects, Litigation counsel's research was extensive due to the complexity of issues regarding the effect of the court’s order rescinding the deed to Bayview Village LLC and restoring title to Rosia Hart, and the chain of title wnen Baum Thornley Architects recorded their lien. Gregory Wiggins testified at his debtor's exam that he had a bank account at the San Francisco Police Credit Union which contained approximately $100. Litigation counsel prepared a Writ of Execution and other forms to levy the monies in that bank account. Gregory Wiggins had closed his account at San Francisco Police Credit Union before the levy was served. At his debtor’s exam on January 22, 2013, Gregory Wiggins stated that he received $2,000 per month in rent from 211 Tanager Way, Hercules (“Tanager Way’). Gregory Wiggins currently holds title to the Tanager Way property. Litigation counsel researched the process of levying the rents paid by Vanessa Bowman, current tenant at Tanager Way. Litigation counsel worked with co-counsel Andrew Schultz to prepare the Writ of Execution and Notice of Levy in order to levy the rents from Tanager Way. Litigation counsel submitted the documents to the Contra Costa County Sheriff's Office on August 5, 2013 and received the first levied rental payment in October 2013. Contra Costa County Sheriff's Office prepares the rent checks payable to litigation counsel. Upon receiving the checks, litigation counsel endorsed the checks in favor of Former DECLARATION OF DANIEL A. CONRAD IN SUPPORT 328 Trustee. Contra Costa County Sheriff's Office has sent checks for this rent levy totaling nearly $12,000. U.S. District Court Judge Charles Breyer contacted me - “not as a judge” - because he knows the tenant's family. He asked me to advise Former Trustee not to pursue the rent levy. | did not agree, and the rent levy has been effective. Former Trustee filed his resignation as trustee on January 29, 2014. Paula Bibbs was appointed as temporary successor trustee on January 30, 2014 and was appointed as general successor trustee on March 25, 2014. Upon receiving the rent checks from the Contra Costa County Sheriff's Office, litigation counsel sent two letters to Ernest Der, attorney for Paula Bibbs, to request that he ask the Contra Costa County Sheriff's Office to make the checks payable to him instead of litigation counsel. Litigation counsel has instructed the Contra Costa County Sheriff's Office to send the checks directly to Ernest Der. c) Fee petition. Litigation counsel prepared and filed Petition for Order to Pay Litigation Counsel Fees, to Continue Legal Representation, and to Waive Notice to Trust Beneficiary (the “fee petition’) on March 29, 2013. The fee petition requested 1) payment to litigation counsel for legal services provided to Former Trustee from December 6, 2011 to February 28, 2013 in the amount of $17,368.69 and 2) to waive notice of hearing to trust beneficiary Gregory Wiggins. Subsequent to filing the fee petition, on June 14, 2013, this Court issued Probate Examiner's Notes which requested that litigation counsel file an Ex Parte petition in order to request authority to waive notice of hearing to Gregory Wiggins. CONRAD IN SUPPORT 41 Litigation counsel prepared Ex Parte Petition for Order to Waive Notice to Trust Beneficiary of Petition for Authority to Pay Litigation Counsel Fees and prepared a Supplement to Petition for Order to Pay Litigation Counsel Fees. Litigation counsel filed the Ex Parte petition and supplement on June 25, 2013 and prepared an order approving 6|| the Ex Parte petition.
