In light of the nature of the allegations against Mr. Gallant, the Court hereby orders a hearing pursuant to SJC Rule 3:07 - Professional Conduct Rule 1.7 Conflict of Interest; Current Clients. At said hearing, the Defendants shall appear and be prepared to indicate under oath (1) whether they have discussed fully with Attorney Gallant and conflict of interest under R 1.7 (a) and (2) if there is or maybe a conflict, whether they give informed consent to Attorney Gallant's representation under R 1.7(b). The Defendant shall file affidavits in accordance w/ R. 1.7(b) as necessary. The Court notes that, "if the probability of a lawyer's own conduct in a transaction is in serious question, it me be difficult or impossible for the lawyer to give a client detached advise." R. 1.7 Commentary [10] Personal Interest Conflicts. "Informed consent requires that each affected client be aware of the relevant circumstances and of the material and reasonably foreseeable ways that the conflict could have adverse effects on the interests of that client."
