Tentative ruling adopted and becomes order: JOINT MOTION TO DISMISS PLAINTIFF'S COMPLAINT TENTATIVE RULING: Based upon the unique facts of this case, the Court GRANTS the parties' joint motion to dismiss Plaintiff's complaint. The dismissal will be with prejudice as to Plaintiff Justin Lie's ("Lie") individual claims and without prejudice as to the PAGA claims. The Court has been the single-assigned judge in this case since it was first filed and has conducted several Case Management Conferences. From the beginning, Defendant Benihana International, Inc. ("Benihana") has vigorously defended this case arguing that another Class and PAGA case, Ari Gold et al. v. Benihana National Corp. et al. barred all or most of this case. There has been a court-approved settlement and release in the Gold case. This case also has issues of the impact of the recent United States Supreme Court decision in Viking River Cruises, Inc. v. Moriana (2022) 142 S.Ct. 1906 involving the applicability of arbitration agreements to PAGA cases. Apparently Lie had an employment arbitration agreement with Benihana because he sought arbitration. Based upon the Court's own review of the facts and law presented regarding the merits of this case, the Court finds that the Gold case provides relief to the case and it would be inefficient use of resources to continue with this case thus making it reasonable for the parties to seek to dismiss this case. Based on these facts, the Court approves the dismissal of the complaint. If the tentative ruling is uncontested, it shall become the order of the Court. Thereafter, counsel for Plaintiff shall prepare a written order consistent with the Court's ruling for the Court's signature, pursuant to California Rules of Court, Rule 3.1312, and provide written notice of the ruling to all parties who have appeared in the action, as required by law and the California Rules of Court. |
