Tentative Ruling:
The plaintiffs’ motion to augment the administrative record with RJN exhibits 6 through 13
is granted in part and denied in part. Specifically, it is granted as to exhibits 6 through 11, and
otherwise denied.
At the status conference, counsel shall be prepared to discuss (1) whether the evidence
will be limited to the AR as augmented, or whether there will be any testimony or other evidence,
and (2) when the hearing shall be conducted. The Court is available any Friday afternoon on May
12 or thereafter.
Analysis:
The fifth amended complaint challenges not only the rates charged, but also how the
revenues collected as the result of those rates is spent. Therefore, the Court disagrees with the
City that only those documents known to th
