Motion denied. The delayed reading of the alternate instruction did not prejudice Defendant. During jury selection, one juror disclosed that she had a pre-planned vacation starting April 29, 2021. Neither Plaintiff nor Defendant asked to excuse the juror, knowing that she would be unavailable after April 28. The jury started deliberation on April 28, the only day that juror would be available to deliberate. At the end of the first day of deliberations, the jury had not reached a verdict. The court released the juror and instructed an alternate to appear the following morning to begin deliberations. On April 29, a deputy sheriff took the 11 remaining jurors and the alternate to the jury deliberation room. The deputy who took the jury that morning was a substitute, so he was unaware that one of the jurors was an alternate.
