Defendant’s Motion to Compel Answers to Supplemental Interrogatory and Supplemental Request for Production.
Defense counsel declares: on February 15, 2019 a supplemental interrogatory and supplemental request for production were served on plaintiff; plaintiff requested an extension of time to respond to June 3, 2019; plaintiff later requested an extension of time to respond up to and including July 26, 2019; on June 3, 2019 defense counsel agreed to the extension upon condition that defendant receive plaintiff’s updated medical records by the end of the week; the records were not received and, therefore, the extension not granted; and as of the date of the declaration that was executed on July 19, 2019, no responses to the supplemental discovery was received. Defendant moves to compel answers to the interrogatory and request for production and production of documents without objections. Defendant has not requested an award of monetary sanctions.
