Defendant represents that on August 31, 2020, the day that the Complaint was filed, it served a deposition subpoena for business records on the Custodian of Records for the Riverside County Sheriff’s Department to obtain police reports and incident reports related to the August 27 house party at the subject property. The production deadline is September 21. Despite Defendant’s diligence in requesting the documents, the requested continuance appears to be necessary to allow Defendant adequate time to review the records and prepare the Opposition. The documents may be relevant to issue of harm if they show that Plaintiff’s use of the property for short-term rentals creates a risk of damage to the property or potential liability for Defendant as the owner.
