I. Background

On July 21, 2000 Plaintiff First Select Corporation (“Plaintiff”) obtained a default judgment against Defendant Lara Karuna Vaidya (“Defendant”). On April 9, 2009, Plaintiff filed an Assignment of Judgment, whereby Plaintiff assigned its right to the default judgment to Judgment Assignee BV Financial Management, LLC (“Judgment Assignee”). The default judgment was twice renewed on April 9, 2009 and October 12, 2018.

On April 29, 2019, Defendant filed a Motion to Vacate Default and Default Judgment (the “Original Motion”) under Code of Civil Procedure sections 473(b), 473(d), and 473.5 and Civil Code section 1788.61. This Court issued
