Tentative Ruling: SUSTAIN the demurrer with 30 days leave to amend.
Plaintiff alleges she is a 55-year-old female who was employed by Walmart beginning in April
of 2005 as an Optician. (Compl. ¶ 11.) Plaintiff alleges she “was discriminated against based on
her associational disability” and that she “made protected complaints including unlawful
discrimination, harassment, and retaliation experienced as a result of her associational
disability.” (Id. ¶ 13.) The Complaint alleges that in 2018, Plaintiff’s mother was diagnosed with
dementia, and Plaintiff requested time off periodically when her mother’s condition worsened.
(Id. ¶ 14.) On 3/17/20, Plaintiff went on COVID LOA, which was extended until 3/18/21. (Id. ¶
