Tentative Ruling:
The County’s request for judicial notice is granted.
The
County’s
application
for
a
temporary
restraining
order
is
denied.
The
County’s
application for an OSC is granted.
Analysis:
The County sues the defendant on the basis that the defendant was the record title owner
of the parcel at the time the action was filed. The defendant counters that he sold the property in
2020. His declaration is not entirely credible, because it is internally inconsistent, inconsistent with
some of the exhibits, and inconsistent with some of the answers that he gave at the hearing on
9-7-22. Nevertheless, the status of the title to the property is sufficiently in question that the Court
declines to issue a TRO.
The
Court
will issue
the
OSC
unless
the
defendant
is able
to present
the
evidence
described at the last hearing that would resolve the issue of title, preferably in the form of a copy
