Tentative Ruling on Motion for Attorney’s Fees: The present motion is unopposed. Defendant Tetra Tech,
Inc. moves for attorney’s fees pursuant to CCP §§ 1032, 1033.5 and Civil Code § 1717 based on an attorney’s
fee provision in a contract between Plaintiffs and the City of Redding. The total amount of attorney’s fees
requested is $69,361.05.
Merits of Motion: A prevailing party is entitled to costs. CCP § 1032. “Costs” may include attorney’s fees if
they are provided by contract. CCP § 1033.5(a)(10). Attorney’s fees are recoverable “in any action on a contract”
if provided for in the contract. Civil Code § 1717. “Any action on a contract” is an action or cause of action that
relates to the agreement sued upon. Douglas E. Barnhart Inc. v. CMC Fabricators, Inc. (2012) 211 Cal.App.4th
