Motion to Stay Action, or Alternatively, Petition for Coordination
Ruling:
For the reasons set forth herein, defendants’ motion to stay Duerst v. Carl Karcher Enterprises, Inc., Sacramento County Superior Court case number 34-2010-00078072, is denied. Defendants’ alternative motion to coordinate this action as an add-on to this coordinated action is denied.

Background:

Carl Karcher Wage and Hour Case I (the “Hourly Cases”) include six previously-
coordinated class action cases. In these cases, the plaintiffs (and those in their alleged classes) are various non-managerial restaurant employees who assert wage and hour claims against their employer, defendants Carl Karcher Enterprises, Inc./ CKE Restaurants, Inc. This court has been assigned presiding coordination trial judge of the Hourly Cases.
