Matter on calendar for Thursday, June 26, 2014, Line 13, DEFENDANT TAXI EQUIPMENT LEASING LLC'S MOTION TO STRIKE 1ST AMENDED COMPLAINT.

In its notice of motion, Defendant first seeks to strike the language in paragraph 29 of the First Amended Complaint ("FAC") as follows: "Defendants Taxi Equipment Leasing?recklessly and negligently owned, operated, and/or controlled the Nissan Taxi Cab driven by Sanchez." However, paragraph 29 of the FAC states "Plaintiff incorporates herein by reference, as though set forth in full, Paragraphs 1 through 28 of this Complaint." Therefore, the motion as to this language is denied as improperly noticed. As to the alter ego allegations, the motion is denied. "California courts have a policy of great liberality in allowing amendments at any stage of the proceeding." (Douglas v. Sup. Ct. (1989) 215 Cal.App.3d 155, 158.)
