Background
Plaintiff Albert Kirakosian (“Plaintiff”) filed this action on December 11, 2013 against Defendants American Best Engineering, Inc. (“ABE”); Avakian Engineering, Inc. (“Avakian Engineering”), Sergik Avakian and Sevak Avakian (collectively, the “Demurring Parties”).
On January 10, 2017, the Court granted Avakian Engineering and Sevak Avakian’s motion for judgment on the pleadings on the grounds that the Complaint disclosed a usurious interest defense. Plaintiff subsequently filed a First Amended Complaint, to which Defendants demurred. The Court granted that demurrer on March 29, 2017, and Plaintiff filed the operative Second Amended Complaint (
