Defendant Harger’s Motion to Quash Service of Process.
Plaintiff filed an unlawful detainer complaint against defendant Harger d.b.a. Tree House Ministries asserting that there was a written lease agreement for the subject property that commenced on June 16, 2019 and terminated on June 30, 2020. Tree House Ministries, Inc. filed an answer by general denial on October 2, 2020.
Defendant Harger specially appears to move to quash service of the summons and complaint on the following grounds: defendant Harger is not the appropriate party in his individual capacity, because he executed the lease as executive director of the Treehouse Ministries; and Tree House Ministries is a non-profit corporation as established in the records of the California Secretary of State.
The proofs of service declare that on October 13, 2020 notice of the hearing was served by mail to plaintiff’s address of record and the moving papers were served by mail to plaintiff’s address of record on October 2, 2020. There
