23. EC065662 MYRNA PERAZA v EVERGREEN SENIOR CARE, INC.
Demurrer and Motion to Strike
Case Management Conference

The Plaintiff alleges that the Defendants were providing residential community living services to Epifania Gallardo, who was dependent on the Defendants to provide her with bathing, grooming, and hygiene care because she had progressive dementia as a result of a stroke. The Defendants neglected the needs of Epifania Gallardo because they recklessly handled her person and dropped her, did not keep her clean and dry, and did not reposition her frequently. As a result, she developed a pressure sore and had an injury on her right knee that was not treated properly for over a month. When the injury on her knee was finally assessed, the Defendants discovered that a bone was protruding through her skin and that the knee had to be amputated.
