The Motion (ROA # 202) of Plaintiff San Diego Association of Governments ("Plaintiff" or "SANDAG") for an Order for access to the levee or, in the alternative, to reopen the previous order for possession entered on March 15, 2017, to enable SANDAG to perform necessary repairs to a portion of the levee to the property located at 5216 Anna Avenue, San Diego, California ("property") adjacent to Plaintiff Anna Avenue Associates, LLC ("Plaintiff" or "Anna Avenue"), is GRANTED. This order is limited to access to restore rip-rap to the levee via access from Friars Road during night time hours. Plaintiff's Request (ROA # 234) for judicial notice is GRANTED IN PAT and DENIED IN PART. The Court takes judicial notice of Exh's "A, C, D and H," and declines to take judicial notice of Exh's "G and I."

Defendant's evidentiary objections (ROA # 240) are OVERRULED IN PART and SUSTAINED IN PART. The objections to no. 1 are OVERRULED. The rest of the objections are SUSTAINED. It is undisputed that the l
