Cross-defendants' amended motion for summary judgment/summary adjudication on the third amended cross-complaint ("TAXC") is DENIED.
Preliminary Matters
The Estate of Fritz Schnick, through Stefanie Pauly as a representative and individual, Renate and Manfred Boekenkamp, Gert Seegardel, and Bernd Wegner (collectively "cross-defendants") exceeded the page limits for their motion. Cal. R. Ct., rule 3.1113(d). Cross-defendants also appear to have violated the rules for font size, margins and spacing (rules 2.104, 2.107, and 2.108), which, if followed, would have increased the length of their brief. Cross-defendants' belated request to file an oversized memorandum also fails to comply with the Rules of Court; in particular, cross-defendants failed to explain why their argument could not be made within the stated limit.
