Plaintiff's motion to relate Bernard v. California Health Facilities Financing Authority, et al. (34-2016-00203224) and California Health Facilities Financing Authority, et al. v. All Interested Persons (34-2017-00219002) and assign the cases to a writ judge is denied.
For the reasons discussed in the Court's concurrent ruling on Defendants' motion to consolidate the actions, the Court finds that consolidation is appropriate. While Plaintiff argues that relating the cases would provide "a newer and more flexible option than consolidation under the California Rules of Court" in this case with "pure or nearly pure issues of law," the Court disagrees. While the moving party argues that the issues "should be decided in a particular sequential order," consolidating rather than relating these cases addresses this issue. If the cases were related, they might proceed on parallel tracks, whereas consolidation allows for case management of both bases in one action and any page limitation concer
