Motion to Strike
The motion of defendant Ralph Ramshaw to strike portions of the First Amended Complaint alleging punitive damages is GRANTED with 10 days leave to amend.
The allegations the defendant was convicted of a second time driving under the influence after the accident are insufficient, in and of themselves, to justify an award of punitive damages.
Case Management Conference
The Court will schedule a 7-day jury trial for January 6, 2020, at 9 am. A Mandatory Settlement Conference will be set for November 8, 2019, at 8:30 am.

Order to Show Cause
