Defendant JR Steel Reinforcing Construction Services, Inc.’s (“JR Steel”) Motion to Compel the Deposition of Plaintiff William Schupp
The motion to compel the deposition is GRANTED. (Code Civ. Proc. § 2025.450(a).) There is no dispute that Defendant is entitled to take Plaintiff Schupp’s deposition. Although the Third Amended Notice of First Deposition for William Schupp was defective since it exceeded the geographic limitations of CCP § 2025.250(a) (Risner Decl., Ex. F), Plaintiff Schupp failed to timely object. Risner Decl., Ex. G. As such, Plaintiff Schupp waived any error or irregularity. (Code Civ. Proc. § 2025.410(a), (b).)
Plaintiff Schupp is ordered to appear for his deposition by videoconference within 45 days. The parties are ordered to meet and confer in person or by telephone within 10 days to discuss the issues identified in Plaintiff Schupp’s May 19, 2020 correspondence.
