Plaintiff Jane Doe’s motion to augment her expert witness list pursuant to CCP §§ 2034.610 and 2034.620 is GRANTED. Plaintiff’s proposed expert, Dr. Suzie Dupee, may testify in Plaintiff’s case-in-chief regarding the psychiatric and psychological testing and results used by Defendant’s expert, as well as a rebuttal witness to Defendant’s expert, Dr. Constance Dalenberg.
It appears that Plaintiff, through the mistake, inadvertence, surprise, and/or excusable neglect of Plaintiff’s counsel, did not designate a psychiatrist as her damages expert on her initial exchange, but that Plaintiff promptly sought to augment her expert witness list to include a damages expert after receiving Defendant’s damages expert’s report and learning of this mistake, and served the proposed expert witness information described in CCP § 2034.260.
