- Overruled, as to the first, second, and fourth causes of action.
- Sustained, with leave to amend within 20 days, as to the third cause of action.
- Sustained, without leave to amend, as to Plaintiff Ray Bulaon
Defendants’ motion to strike is DENIED.
On January 16, 2020, Plaintiffs Ray Bulaon and Christina Gila filed suit against Blandina Largo and Remigio Largo, alleging: (1) breach of the warranty of habitability; (2) breach of the covenant of quiet enjoyment; (3) retaliatory eviction; (4) collection of rent on substandard dwelling Civil Code section 1942.4; and (5) negligence.
Defendants now demur to Plaintiffs’ Complaint. Defendants also move to strike portions of Plaintiff’s Complaint.
