BACKGROUND


On April 25, 2019, Plaintiff Margarita Ramos (“Plaintiff”) filed a complaint against Defendants John T. Hayden and LB Property Management (“Defendant LB”). Plaintiff alleges premises liability and negligence in the complaint for injuries sustained on January 1, 2018 from an exposed nail inside Plaintiff’s apartment.


On August 22, 2019, Plaintiff filed an amendment to her complaint to rename Doe 1 as Defendant Consolidated Property Services, Inc. (“Defendant Consolidated”).


On October 23, 2020, the Court granted Plaintiff’s motion for trial preference.


On January 28, 2021, Defendant Consolidated filed a motion to set aside the Court’s November 30, 2020 order granting Plaintiff’s motion for trial preference.
