On December 23, 2019, Scott Madel filed an unlimited civil complaint against BioHealth Diagnostics Laboratory and Joan Hunziker asserting causes of action for: (1) breach of contract; (2) breach of implied covenant of good faith and fair dealing; (3) specific performance; (4) fraud; (5) conversion; (6) violation of Corporations Code § 212(a); (7) intentional infliction of emotional distress; (8) failure to pay wages in timely manner (Labor Code §§ 201, 204); (9) failure to furnish accurate wage and hour statements (Labor Code §§ 226 and 226.3); (10) failure to maintain accurate payroll records (Labor Code §§ 226, 1174, and 1174.5); and (11) declaratory relief. On July 27, 2020, the court sustained Defendants’ demurrer to the seventh cause of action with leave to amend and Plaintiff did not timely amend the
