TENTATIVE RULING

Defendants Peter M. Newton, M.D., Newton Medical Evaluations, Inc., a California Corporation fka Peter M. Newton, M.D., a Medical Corporation’s Demurrer to Plaintiff’s First Amended Complaint is SUSTAINED, without leave to amend, as to the first, second and third causes of action.

Defendants Peter M. Newton, M.D., Newton Medical Evaluations, Inc., a California Corporation fka Peter M. Newton, M.D., a Medical Corporation’s Motion to Strike Portions of Plaintiffs’ First Amended Complaint is GRANTED, with leave to amend, pending the filing of a motion pursuant to Code of Civil Procedure section 425.13, as to the prayer for punitive damages (but only if timely as per statute), and GRANTED, with twenty (20) days leave to amend, as to the alter ego allegations in paragraph 7 of the First Amended Complaint.
