Defendants Level Up Solutions, Inc., Hahn and Marley's Demurrer is OVERRULED.

I. Background

This action was initiated on April 9, 2018 in an unlimited jurisdiction court and was reclassified on October 9 to a limited jurisdiction court. On August 1, 2018 (re-filed as October 9 in this Court), Plaintiff Creative Support (“Plaintiff”) filed the operative First Amended Complaint (“FAC”) against Defendants Level Up Solutions, Inc. (“LUS”), Michael Harley (“Harley”), and Shannon Hahn (“Hahn”) (collectively, “Defendants”), asserting causes of action for (1) breach of loyalty, (2) breach of fiduciary duty, and (3) violation of the Business and Professional Code § 17200 et seq. (“UCL”).
