DISCUSSION

On October 18 2018, Plaintiff Aleksandr Bible (“Plaintiff”) filed the instant action against Defendant Geico Indemnity Company, LLC (“Defendant”). On December 20, 2018, Defendant filed a Demurrer to the Complaint, set for hearing on January 31, 2019. On December 24, 2018, Plaintiff filed a First Amended Complaint. The First Amended Complaint was timely brought prior to the deadline for Plaintiff to bring an opposition (nine (9) court days prior to the hearing). (See Code Civ. Proc., §§ 472, subd. (a); 1005, subd. (b).) Accordingly, Defendant’s Demurrer to the Complaint is placed off calendar as moot. Court clerk to give notice.
