Motion for Leave to Intervene by Insurance Company of the West, filed on 7/30/19, is GRANTED. Insurance Company of the West is to file its proposed Complaint in Intervention within ten (10) days.
Intervention is proper where the intervenor shows an interest relating to the property or transaction which is the subject of the action and disposition of the action may as a practical matter impair or impede that person’s ability to protect the interest. Code Civ. Proc., § 387(d)(1).
Intervenor can join as a party in the employee’s suit under Labor Code § 3852 since intervenor paid benefits to Plaintiff/employee for injuries suffered because of Defendant’s alleged negligence. Declaration of Daniel B. McCarthy, ¶¶ 4-6. Cal Lab Code § 3852; Cal Lab Code § 3850.
