Background

On October 24, 2018, Plaintiff Xin Yuan (“Plaintiff”) filed a complaint against Defendants Brimo LLC (“Brimo”); Alfredo Gonzalez ("Alfredo"); Miguel Angel Gonzalez ("Miguel"); American Trust Escrow Inc. (“American Trust”); Carsten Phillips, Inc., d.b.a. RE/MAX Titanium ("Carsten"); Kevin Truong ("Truong"); Rudy Kusuma ("Kusuma"); and Realty One Group Affiliates, Inc. ("Realty One"). This action arises from the purchase of real property commonly known as 616 Gartel Drive, Walnut, California 91789 ("Property") by Plaintiff from Brimo. The Complaint asserts multiple causes of action, including breach of contract, negligence, fraudulent misrepresentation, negligent misrepresentation, and breach of fiduciary duty, against the defendants Brimo, Alfredo, Miguel, Carsten, Truong, Kusuma, and Realty One. Yuan alleges the breach of contract and negligence claims against American Trust.
