Defendant So Hyung Kim’s Motion to vacate Sister State Judgment is CONTINUED to March 27, 2018. CCP §§ 128 and 1005.
This matter was originally scheduled for hearing on December 14, 2017. The Court continued the hearing because the Proof of Service submitted by Defendant So Hyung Kim was deficient because Plaintiff’s address was incorrect as listed. Plaintiff’s correct address is 555 Marin Street Suite 140, Thousand Oaks CA 91360, not Marlin Street as stated in Defendant’s Proof of Service.
The Court ordered Defendant So Hyung Kim to serve the motion at the correct address and file a properly executed proof of service in accordance with CCP § 1005 directly with Department 77 by January 22, 2018. The Court order noted that late filed papers will not be considered by the Court and may result in the motion being denied outright.
Though Defendant So Hyung Kim filed a notice of change of address on January 17, 2018, which was addressed to Plaintiff’s correct address, he failed to file a
