On October 11, 2016, Plaintiff Victor Gouche (“Plaintiff”) filed the instant action against Defendant Carlos J. Jimenez (“Defendant”) for discrimination on the basis of disability. Defendant filed his Answer on December 12, 2016. Trial in this matter was scheduled for April 11, 2018. When Defendant failed to appear at trial, the court entered judgment in favor of Plaintiff. On May 22, 2018, the court granted Plaintiff’s motion for attorneys’ fees. Defendant filed the instant motion to vacate the judgment on September 7, 2018.
The motion was initially scheduled for hearing on September 27, 2018, at which time the court continued the hearing for lack of statutory notice. The court gave notice of the new hearing date on the same day. Plaintiff filed his substantive opposition on October 3, 2018. To date, no reply has been filed.
