Robert Reynolds’ Demurrer to Trust Petition of James Reynolds
Overrule. The Court finds that Robert Reynolds’ counsel’s meet and confer efforts made immediately after the initial hearing on October 31, 2016 were sufficient under the circumstances, in that at the time of the meet and confer the parties had already briefed all the issues and so were fully aware of the arguments in support of and against their positions.
Robert Reynold’s Request for Judicial Notice is granted.
The Demurrer is overruled. The Court finds that for purposes of surviving a demurrer, James Reynolds has stated sufficient facts to support his standing to file the Petition, and to support each of his causes of action.
A verified response to the Petition must be filed by Robert Reynolds by no later than Friday, December 23, 2016.
