Nature of Proceedings: Motion for Summary Judgment/Adjudication
The court grants the motion for summary adjudication of the breach of contract cause of action only but not the open book account cause of action. Plaintiff Wescom Credit Union will be entitled to judgment against defendant Joel Nava in the amount of $11,824.55, plus interest from January 31, 2007. The court finds plaintiff is not entitled to attorney fees on the breach of contract cause of action. The trial date of February 25, 2008 will be on the open book account cause of action only.
