Plaintiff Natasha Y. Quince files this Motion for Final Hearing on the Complaint for
Declaratory Judgment and Disbursement of Surplus Funds, and in support thereof state:
1. Defendant CapOne CLTRL Assignee of Fig 2233 was served with Summons and
Complaint on December 11, 2019, to which no response was given. The Clerk of
Court entered a Default against Defendant on January 3, 2020.
2. Defendant US Bank, National Association as Trustee for Master Alternative Loan
Trust 2005-1 was served with Summons and Complaint on December 10, 2019.
Pursuant to Order granting unopposed Motion to Vacate Default, an Answer and
Affirmative Defenses was filed on January 21, 2020.
3. The time within which to file a responsive pleading has lapsed and the issue is ripe
for adjudication.
WHEREFORE Plaintiff requests a final hearing be scheduled in this matter,
accordingly.
