MOTION FOR DISCHARGE AND
REPORT OF ATTORNEY, ADMINISTRATOR AND GUARDIAN AD LITEM
COMES NOW, the Guardian Ad Litem, Administrator Ad Litem, and Attorney Ad Litem, JULIA
B. KITE-POWELL, ESQUIRE, and files this report concerning the diligent search for the
defendant(s), Unknown Heirs, Beneficiaries, Devisees, Surviving Spouse, Grantees, Assignee,
Lienors, Creditors, Trustees, and all other parties claiming an interest, by, through, under or against
the Estate of Robert M. Dickens, deceased, and being duly sworn, deposes and says of her own
personal knowledge:
1. That I was appointed Guardian Ad Litem, Administrator Ad Litem, and Attorney Ad Litem.
2. That I reviewed the Lis Pendens, Mortgage Foreclosure Complaint with Exhibits and Service
Returns filed by Plaintiffs counsel and Death Certificate as provided by Plaintiff's counsel.
3. That I filed an answer as Guardian Ad Litem, Administrator Ad Litem and Attorney Ad
Electronically Filed Marion Case # 19CA002539AX 03/12/2020 03:12:22 PMLitem.
4. That a search of the public records was conducted for information pertaining to the
subject property and the Unknown Heirs, Beneficiaries, Devisees, Surviving Spouse,
Grantees, Assignee, Lienors, Creditors, Trustees, and all other parties claiming an
interest, by, through, under or against the Estate of Robert M. Dickens, deceased.
5. That the obituary of Robert M. Dickens, deceased was ordered and reviewed for heirs of
Robert M. Dickens, deceased.
6. That an Internet search was conducted for possible heirs of Robert M. Dickens, deceased.
7. That contact with all persons listed as possible relatives of Robert M. Dickens, deceased
was attempted.
8. That a search Probate records was conducted and it was ascertained that no probate file has
been opened pertaining to the Estate of Robert M. Dickens, deceased. However, a Last Will
and Testament was deposited with the court. I ordered the Will and reviewed same. The
purported Will identifies the decedent’s children as Cheryl Sponagle, Michelle Novella and
Annie Laurie Barrish. The estate is devised to Cheryl Sponagle.
9. That in my searches and investigation for the possible heirs, I ascertained that Robert M.
Dickens was survived by three children, Cheryl Sponagle, Michelle Novella and Annie
Laurie Barrish.
10. That the above information has been provided to counsel for Plaintiff.
That the fee requested for services as Guardian Ad Litem herein is $550.00.WHEREFORE, the undersigned counsel respectfully requests this Honorable Court enter
an Order of Discharge and granting her award of attorney’s fees.
