PLAINTIFF’S RESPONSES TO DEFENDANT ROYAL OAK HOMES, LLC’S FIRST REQUEST FOR ADMISSIONS Plaintiff, VILLAS AT EMERALD LAKE HOMEOWNERS ASSOCIATION, INC., by and through its undersigned counsel, and pursuant to Rule 1.370, Florida Rules of Civil Procedure, responds as follows to Defendant, ROYAL OAK HOMES, LLC’s First Request for Admissions: 1. Please admit that the Villas at Emerald Lake Homeowners Association, Inc. is the homeowners association for the Emerald Lake Development.RESPONSE: Admitted. 2. Please admit that the Villas at Emerald Lake Homeowners Association, Inc. directly or through its attorneys has retained Marcon Forensics LLC. RESPONSE: Admitted. 3. Please admit that Marcon Forensics LLC conducted a visual assessment of the Emerald Lake Development on September 19, 2019. RESPONSE: Admitted. 4. Please admit that the Villas at Emerald Lake Homeowners Association, Inc. did not notify a representative of Royal Oak of the visual assessment of the Emerald Lake Development conducted on September 19, 2019 before that visual assessment took place. RESPONSE: Admitted. 5. Please admit that Marcon Forensics LLC recommended destructive testing at the Emerald Lake Development after the visual inspection conducted by Marcon Forensics LLC on September 19, 2019. PONSE: Denied as phrased. 6. Please admit that Marcon Forensics LLC recommended destructive testing at the Emerald Lake Development to test hypotheses that construction was performed in violation of building code requirements or in violation of manufacturer’s installation requirements at the Emerald Lake Development. RESPONSE: Denied as phrased. 7. Please admit that You requested or permitted destructive testing to be performed at the Emerald Lake Development in January 2020. RESPONSE: Admitted. 8.
