ORDER
THIS CAUSE having come before this Court for hearing on November 15, 2021, upon
Defendant, HOOTERS OF PORT CHARLOTTE, INC.’s (“HPC”) Motion for Entry of a
Confidentiality Protective Order and Motion for Enlargement of Time (the “Motion”), and the ore
tenus request the Court designate this case a complex case, the Parties being present and the Court
having heard argument of counsel and being otherwise duly advised in the premises, it is hereby
ORDERED that
1. Defendant, HOOTERS OF PORT CHARLOTTE, INC.’s (“HPC”) Motion for
Entry of a Confidentiality Protective Order and Motion for Enlargement of Time is GRANTED
IN PART and the Order on the rulings shall be submitted via separate Order.
2. This action is designated as complex under Fla. R. Civ. P. 1.201.
3. The parties shall submit a proposed amended case management plan within 10 days.4. The Court hereby vacates the Order of Referral to Non-Binding Arbitration dated
September 23, 2021 in light of the forthcoming amended case management plan.
5. Mediation shall occur prior to Non-Binding Arbitration unless the parties agree to
a hybrid mediation/non-binding arbitration.
6. The Non-Binding Arbitration shall be conducted by a single arbitrator.
