Thomas ied, NOTICE OF INVOCATION OF CONSTITUTIONAL RIGHTS ALL PERSONS take notice that the undersigned person, while in custody and under arrest, invoke all state and federal constitutional rights available to me and specifically including the RIGHT TO REMAIN SILENT (U.S. Const., Amendments V & XIV and article I, § 9 of the Florida Constitution) and the RIGHT TO COUNSEL (U.S. Const., Amendments V, VI & XIV and article I, § 16(a) of the Florida Constitution, Florida Rule of Criminal Procedure 3.130). See Miranda v. Arizona, 384 U.S. 436 (1966), Edwards v. Arizona, 451 U.S. 477 1880 (1981); McNeil v. Wisconsin, 501 U.S. 171 (1991); Michigan v. Jackson, 475 U.S. 625 (1986). I invoke all available rights under international treaties and agreements. I hereby express my unequivocal desire for the assistance of a competent attorney to deal with all forms of interrogation by law enforcement agencies and their agents concerning all criminal activity. I demand that my civil rights be respected and all law enforcement personnel and their agents and prosecutors and their agents avoid conversing with me concerning any type of criminal activity whatsoever unless my attorney is present. I refuse to hereafter waive any constitutional in the absence of my attorney. Anyone hereafter violating my CONSTITUTIONAL RIGHTS is subject to legal action for sanctions and/ or damages under 42 U.S.C. Section 1983. See Hafer v. Melo, 502 U.S. 21, 24 & 31 (1991). Be it known that I do not now nor in the future if my attorney is absent: a. Agree to speak with any jail psychologist or anyone in the ministry employed by the jail concerning the charges against me or any matter related thereto unless my attorney is present. b. Consent to appear in any line-up, show-up or other identification procedure without the opportunity to confer with my attorney about my rights and to have him present for that procedure. c. Consent to interviews in any form with members of the media or law enforcement without the presence of my attorney. d. Consent to any polygraph test or voice stress examination, or the giving of any voice sample, handwriting exemplar, hair, blood, urine, saliva, skin sample or fingernail scraping without the opportunity to confer with my attorney about my rights and to have him or her present for that procedure. e.
